According to the Labor Contract Law of PRC and relevant laws and regulations, Party A and Party B sign this contract on the basis of equality, free will and mutual consultation.一、工作内容

Article One Working Contents 1.1 甲方因生产需要,同意聘用乙方为本公司员工,职位为 乙方同意接受该安排,遵守劳动纪律和职业道德,执行劳动安全规程,提高职业技能,完成生产(工作)任务。

To meet the production demand, Party A agrees to employ Party B as.Party B agrees to accept the arrangement, observe the labor discipline and professional ethics, carry out rules of safe operation, improve professional skills and accomplishes production tasks.1.2 甲方可根据生产经营需要依法调整乙方的工作岗位或职位。

Party A may legitimately adjust Party B’s post according to business requirements.a

二、合同期限

Article Two Term of Contract 本合同自 年 月 日至 年 月 日。劳动合同的期限届满或约定的终止条件出现,劳动合同即终止执行。经双方协商一致的,可以解除或续订劳动合同。

Article Three Working Hours 3.1 甲方实行每周工作 小时和 天休息日的标准工时制度。Party A carries out standard working hours system of hours per week and rest days(maybe they are not Saturday, Sunday).3.2 甲方因工作需要,在乙方愿意的前提下,可依法安排乙方超时工作或公休日加班。

Party A may legitimate arrange Party B to work overtime or work on general holidays due to business requirements on condition that Party B is willing to do so.3.3 甲方由于工作需要更改工时制度,经政府有关部门批准后,乙方应密切配合执行。Party A may change working hours system for business requirement after approval by relevant government authorities and Party B shall execute it of his own will.四、薪酬

Article Four Remuneration 4.1 甲方支付乙方的每月基本工资为人民币 元。上述薪酬不包括甲方按公司补贴规定按月向乙方支付的所有补贴。Party A pays to Party B as basic wage per month.The aforesaid remuneration excludes all subsidies paid to Party B pursuant to Party A’s stipulation.4.2 甲方严格执行国家有关最低工资的规定和标准。

Party A shall strictly implement relevant regulations and standard per the lowest wage.4.3 甲方的发薪日期为每月 日。

Party A shall pay the wage on the day every month.五、劳动保护与劳动条件

Article Five Labor Protection and Labor Conditions 5.1 甲方须对乙方进行劳动安全、业务技术及劳动纪律等方面的教育和培训,并根据国家对劳动保护、安全生产的要求,为乙方提供必要的生产(工作)条件,保障乙方的安全健康。Party A shall give Party B education and training programs relating to labor safety, professional skills and labor disciplines etc.According to the requirements of state labor protection and safe-production, Party A shall provide necessary working condition to ensure Party B’s safety and health.六、社会保险和福利

Article Six Social Insurance and Welfare 6.1 甲方依法替乙方办理各项社会保险并缴纳保险费用。但依法规定之分摊比例,属于乙方须自行负担之各项社会保险金,由甲方于每月发薪时,从乙方薪资中代扣代缴。

Party A shall transact social insurance and pay them for Party B.Party A shall withhold the social security contribution legally undertook by Party B when paying the remuneration every month.6.2 乙方享有国家规定的所有法定假日。

Party B will take all statutory holidays stipulated by the State.6.3甲方实行年休假制度,乙方连续工作满一年以上的可享受有薪年假,申请享受办法按甲方制定的年假规定执行。

Party A carries out annual vocation system, Party B can take paid annual vocation after continuously working for 1 year and the applying procedure for annual vocation shall be done pursuant to Party A’s stipulation.七、乙方责任

Article Seven Party B’s Responsibility 7.1 乙方必须认真工作和劳动,保质保量地完成自己的生产任务。

Party B must work earnestly and accomplish its own tasks with quality and quantity.7.2 乙方必须如实汇报工作,积极配合和协助上级的工作。

Party B must report its job according to the facts and shall cooperate with its uppers and assist their jobs.7.3 乙方应严格履行甲方依法制定的规章制度和《员工手册》。

Party B shall strictly implement the rules and regulations and Handbook legally stipulated by Party A.7.4 乙方应爱护甲方的财物,对由于本人责任造成的直接经济损失,必须予以赔偿并接受甲方的处罚。

Party B shall take good care of Party A’s property and he/she must indemnify direct damage due to his/her liability and accepts Party A’s punishment.7.5 乙方在劳动合同有效期内未经甲方事先书面同意,不得为另一家雇主工作。

Party B can not work for another employer without Party A’s written consent in the duration of Labor Contract.7.6 乙方应严格保守甲方的商业秘密,不得向任何第三方泄露。

Party B shall strictly keep Party A’s trade secret and can not divulge to any third party 7.7 如实陈述履历和学历。

Party B shall state his/her curriculum vitae and educational background according to the facts.7.8 如甲方委派乙方培训(包括海外培训),乙方必须遵守甲方的培训条规和承诺。

Party B shall observe Party A’s training rules and undertaking when Party A assigns Party B to be trained.八、甲方无偿解除合同

Article Eight Cancellation of the Contract without Compensation by Party A 若符合下列情况之一的,甲方可以随时解除合同,而不必给予乙方任何经济补偿:

Party A may cancel the Contract at any time without compensation to Party B under the following circumstances: 8.1 当乙方在试用期内不符合甲方的职工录用条件,甲方无须给予乙方解除的原因。

When Party B is proven to be unqualified for Party A’s employment conditions during probation period, Party A need not give Party B the reason for cancellation.8.2 乙方严重违反甲方依法制定的规章制度和劳动纪律。Party B seriously violates rules and regulations, labor discipline legally stipulated by Party A.8.3 乙方严重失职,营私舞弊,给甲方利益造成重大损失。Party B seriously neglects his/her duty and grafts resulting in Party A’s great loss.8.4 乙方违反中国法律,受到司法处罚或追究刑事责任。Party B violates the laws of PRC and gains judicial punishment or is found a guilty.九、甲方有偿解除合同

Article Night Cancellation of the Contract with Compensation by Party A 有下列情形之一的,甲方可以解除劳动合同,但是应当提前30天以书面形式通知乙方或支付一个月基本工资代替,并依法支付乙方经济补偿金或补助费。

Under the following circumstances, Party A may cancel the Contract with 30 days prior written notice to Party B or paying one month basic wage instead and legally pay economic compensation or subsidy to Party B.9.1 乙方患病或非因工受伤,医疗期满后仍不能从事原工作或由甲方另行安排的工作的。Party B is ill or non-work-related injured, and unable to do the former job or other job assigned by Party A after medical treatment.9.2 乙方不能胜任工作,经过培训或调整工作岗位,仍不能胜任的。

Party B is not competent for the job and still remains so after training or adjustment of the post.9.3 本合同订立时所依据的客观情况发生重大变化,致使本合同无法履行,甲乙双方不能就变更本合同达成协

议的。

The basis for the conclusion of the contract has greatly changed so that the contract can no longer be carried out, while both parties can not reach an agreement on modifying the contract by mutual negotiation.9.4甲方濒临破产,进入法定整顿期间或者生产经营状况发生严重困难,达到当地人民政府规定的严重困难企 业标准,确须裁减人员,并按法定程序解除劳动合同的。Party A is close to bankruptcy and enters into legal rectification period or it is in a severe difficulty to meet the standard of severe difficult enterprise stipulated by the local government and the retrenchment is needed, and then Party A cancels the contract according to legal procedure.十、乙方要求解除合同

Article Ten Cancellation of the Contract at Party B’s request 10.1 乙方要求解除劳动合同,应当提前三十天以书面形式通知甲方,但必须依照11.2条款赔偿甲方。

Party B shall give 30days prior written notice to Party A when requesting to cancel the Contract, but he/she shall indemnify Party A according to Article 11.2.10.2 乙方在下列情况下,可随时通知甲方解除劳动合同。Under the following circumstances, Party B may inform Party A to terminate the Contract at any time.a.在试用期内。

Be in probation period.b.甲方不按照劳动合同支付劳动报酬或者提供劳动条件的。

Party A didn’t pay the remuneration or provide working conditions according to the Contact.c.甲方以暴力威胁或者非法限制人身自由的方法强迫乙方工作的。

Party A forces Party B to work by means of force, threat or illegal restriction of personal freedom.十一、违约责任

Article Eleven Liability for Breach of Contract 11.1 甲方依第9条提前解除合同,应按法律规定向乙方支付经济补偿金。

Party A shall legally pay economic compensation to Party B when canceling the Contract pursuant to Article Night.11.2 乙方违约不履行合同,应按《培训合同》的约定及法律法规的规定赔偿甲方的经济损失。Party B shall indemnify Party A for its economic loss according to laws and regulations and Training Agreement when he/she breaches the Contract.十二、合同附件

Article Twelve Annexes of the Contract 12.1 本合同的附件为本合同不可分割的组成部分,与本合同具有相等的法律效力。

The Annexes are indivisible parts of this contract and they have the same effect as this contract.12.2 甲方依法制定的《员工手册》及各项规章制度是本合同的附件。

Handbook and other rules and regulations legally stipulated by Party A are annexes of this Contract.十三、劳动争议

Article Thirteen Labor Dispute 甲乙双方若发生劳动争议,应通过友好协商解决;若不能解决,可以向当地有管辖权的劳动争议仲裁委员会申请仲裁;对仲裁不服的,可向人民法院起诉。提出仲裁的一方应当在劳动争议发生之日起60天内向劳动争议仲裁委员会提出书面申请;当事人对仲裁裁决不服的,可以在收到仲裁裁决书之日起15天内向人民法院起诉。

If labor dispute occurs, both parties shall resolve it through consultation.In case of failing to reach an agreement, each party may submit the dispute to Labor Dispute Arbitration Committee having jurisdiction.If rejecting the award, each party can take a proceeding.The party applying for arbitration shall submit the arbitration application to Labor Dispute Arbitration Committee within 60 days when the labor dispute arises.If rejecting the award, the party can sue to the court within 15 days after receipt of the award.十四、合同生效

Article Fourteen Effectiveness of the Contract 本合同自甲、乙双方签订后生效。

This contract is effective by signatures of both parties.十五、其它

Article Fifteen Miscellaneous 15.1 本合同未尽事宜,可由甲、乙双方另行订立补充条款,补充条款与本合同具有相同的法律 效力。

If there is something unclear, both parties may conclude a supplement clause and the clause shall have the same effect as this contract.15.2 在合同履行中,发生其他事项而本合同未明确的,按国家和地方有关法规执行。有关条款如国家和地方有新的法规规定,按新的规定执行。

If there is something undefined in this contract when implementing this contract, IT SHALL BE EXECUTED ACCORDING TO RELEVANT LAWS AND REGULATIONS OF THE STATE AND REGION.If there is a new stipulation per relevant clauses, they shall be carried out pursuant to aforesaid stipulation.15.3 本劳动合同的变更须经甲、乙双方协商同意,并办理合同变更手续,合同变更的内容,可由双方商定。

The modification of this contract shall be mutually agreed by both parties and shall be facilitated with the relevant procedure.The modified content can be agreed by both parties.15.4 本合同一式二份,甲、乙双方各执一份。

三、合同条款 3.Terms and Conditions 第一条(合同类型与期限)Article 1 Type and Validity Term of Agreement

1、乙方的工作地点由所在部门安排。今后因工作需要乙方在甲方所在本市的全部经营办公场所及附属场所(包括公司自有产权的物业或租赁的物业,)之间调整时。

1.Party B’s working site is to be arranged by the division he or she works in;Party A is to change Party B’s working site within all its business offices and attached sites in the city where Party A is domiciled(including Party A’s own property or other premises leased by Party A), on the basis of Party A’s working requirement;

2、甲方因工作需要,临时指派乙方到境内外短期出差地点工作的。

2.Party A assigns Party B to work at home or abroad on business travel for a short term on the basis of Party A’s working requirement.3、甲方因工作需要,安排乙方临时外借到其它部门或其它他单位工作的。

3.In response to working requirement, Party A temporarily assigns Party B to work at other divisions of Party A or other entities.(四)因工作需要,乙方被指派到外省市或境外企业或机构长期工作的,协商一致后,本合同作变更处理。

2.4 Where, in response to working requirement, Party A assigns Party B to work in enterprises or organizations located in other provinces or municipalities or abroad for long period, this Agreement may be altered on the basis of mutual consent through negotiation.第三条(工作时间和休息休假)Article 3 Working Hours and Holiday

(一)乙方的岗位实行全日制标准工时工作制度,甲方安排乙方每日工作时间不超过8小时,每周工作五天。

3.1 Party B is to work under the full-time standard working time system: Party A may require Party B to work for no more than 8 hours every day and for five days every week.(二)甲方由于工作需要,经与乙方协商后可以延长工作时间,一般每日不超过1小时,因特殊原因需要延长工作时间的,在保障乙方身体健康的前提下工作时间不得超过3小时,每月不得超过36小时。

3.2 If necessary for work, Party A may, on the basis of negotiation with Party B, extend Party B’s working hours for no more than one hour every day generally;where it is necessary to extend working hours under special circumstances, such extension of working hours may not exceed three hours every day on the premise of being no harmful to Party B’s health, and no more than a total of 36 hours every month.(三)乙方有享受国家规定的各类休息休假的权利,具体按甲方的《职工工作时间及休息休假管理办法》执行。

3.3 Party B is entitled to all the holidays and leaves provided by the State, to which the Implementation Rules for Employees Working Hours and Holidays formulated by Party A shall apply.(四)如遇国家或本市政府有关部门调整工作时间和休息、休假时间,或甲方在特殊季节临时调整休息、休假时间的,不作本合同变更处理。

3.4 Where the State or the relevant authorities of this local municipality readjusts the provisions on working hours, holidays or leaves, or Party A readjusts the provisions on holidays or leaves, this Agreement may not be deemed as being altered.第四条(劳动报酬)Article 4 Remuneration

(一)乙方的劳动报酬包括每月发放的固定工资和以及相关的津贴补贴、每季度考核发放的绩效工资等部分组成,按照甲方薪酬管理规定执行。合同签订后甲方发给《职工薪酬告知书》,具体明确薪酬类别和标准。《职工薪酬告知书》作为本合同的附件,与本合同具有同等法律效力。4.1 The remuneration for Party B includes fixed monthly salary, allowance, quarterly performance-based wage and the like, and the remuneration is to be paid in accordance with Party A’s regulations on remuneration.After execution hereof, Party A is to send Party B a Notification of Employee’s Remuneration, which specifies the type and standard of the remuneration;such Notification constitutes an annex to this Agreement and have the same legal binging force as this Agreement.(二)在履行本合同期间的日常操作中,甲方依照《职工薪酬告知书》中约定的薪酬标准作以下扣除处理的,本合同不作变更处理。

4.2 If, in the course of the performance of this Agreement, Party A deducts any payment of the remuneration in accordance with the Notification of Employee’s Remuneration, this Agreement may not be deemed as being altered.1、由公司代扣代缴的个人所得税。

2、由职工个人承担的社会保险费、住房公积金、企业年金的扣款。

3、因职工违反公司规章制度所发生违约金、赔偿等扣款。

4、因职工发生事假等非带薪假期所作的扣款。

5、因法院对职工涉案判决所指定公司执行的扣款。

6、其它符合法律及公司制度而发生的扣款。

1.Individual income taxes withheld and paid by Party A on behalf;2.The part of social insurance premium, housing accumulation funds, enterprise annuity to be borne by Party B;3.Penalty, compensation and the like arising from Party B’s breach of Party A’s regulations or rules;4.Deduction of remuneration made by Party A owing to private affair leave and leaves taken by Party B other than leaves with payment;5.Deduction of remuneration made by Party A under the order of court on the basis of the judgement of case concerning Party B;6.Deduction of remuneration in compliance with laws or Party A’s regulation system.(三)在本合同期间,甲方因调增职工薪酬标准的,本合同不作变更处理。

4.3 If, during the validity term of this Agreement, Party A increases the remuneration for employees, this Agreement may not be deemed as being altered.(四)甲方每月5日以货币形式通过银行转账到乙方个人帐户的办法支付乙方工资,包括岗位工资、工龄工资及按月发放的相关补贴。乙方同意属于乙方可得的绩效工资、补贴津贴等按甲方薪酬管理规定的日期和形式发放,届时甲方以电子邮件等形式通知乙方。

4.4 Party A shall, on the fifth day of each and every month, pay Party B remuneration by transferring the currency to Party B’s account through bank, including post-based wage, working age-based wage and relevant allowance to be paid on a monthly basis.Party B agrees that all the performance-based wage, allowance and the like may be paid on the date and by the means provided by Party A with respect to remuneration, and Party A is to notify Party B by means of email of the payment thereafter.(五)若乙方提供了正常劳动,甲方支付给乙方的工资报酬不得低于本市政府规定的最低工资标准。

4.5 The remuneration paid by Party A to Party B may not be less than the minimum level provided by the local municipal government, provided that Party B provides normal work for Party A.(六)甲方每月向乙方发放上月工资清单。该清单属于保密范围,应妥善保管,不得泄露给本人家庭成员以外的任何第三人、员工之间不得相互打探,如有疑义可以向甲方人力资源部咨询。4.6 Party A shall, on a monthly basis, send Party B remuneration list for the last month;such remuneration list must be treated as confidential information and kept properly, and such list may not be disclosed to any third parties other than the family members of Party B;employees may not enquire of one another about the remuneration;in the event of any objection, Party B may consult Party A’s human resource department.第五条(社会保险及其它)Article 5 Social Insurance and Other Matters

(一)甲方按照国家和上海市的有关规定,为乙方交纳社会保险和住房公积金。

5.1 Party A shall pay social insurance premium and housing accumulation funds for Party B in accordance with the relevant regulations of the State and Shanghai municipality.(二)乙方原意按照国家和上海市的有关规定,由个人承担的社会保险、住房公积金部分由甲方在工资中代扣代缴。

5.2 Party B agrees that Party A may, from the remuneration payable to Party B, withhold the part of social insurance premium and public remuneration fund to be borne by Party B and Party A may pay such withheld part on behalf, in accordance with the relevant regulations of the State and Shanghai municipality.(三)乙方因病或非因工负伤期间,享有上海市规定的医疗期和疾病休假待遇。

5.3 If Party B suffers sickness or non-work-related injury, Party B is entitled to medical treatment period and sick leave treatment provided by Shanghai municipality.(四)符合计划生育政策的乙方(女职工)享有本市规定的产假和其它特殊待遇,事前乙方须提出申请,经甲方(但不限于甲方,如果需要政府有关机构审核批准的)核准后执行。

5.4 Party B(if Party B is a female employee)is entitled to maternity leave and other special treatment provided by this local municipality, provided that she must be in compliance with the State’s family planning policy and Party B shall submit an application to Party A(if the approval of the government is necessary, Party B shall submit such application to competent authorities)for approval in advance.(五)乙方享有甲方按国家或本市政府及甲方的规定设定的福利待遇,具体按甲方的有关办法执行。

5.5 Party B is entitled to the welfare provided by Party A in accordance with the relevant provisions made by the State, the local municipal government or Party A;Party A’s relevant implementation rules shall apply to the welfare.(六)如遇国家或本市政府调整社会保险、住房公积金的政策,甲方相应调整乙方的社会保险、住房公积金的,本合同不作变更处理。

5.6 If, in the event of the readjustment made by the State or local municipal government of the policy on social insurance or housing accumulation fund, Party A readjusts the social insurance and housing accumulation fund for Party B accordingly, this Agreement may not be deemed as being altered.第六条(劳动保护、劳动条件和职业危害防护)Article 6 Labor Protection, Working Condition and Prevention against Occupational Hazard

(一)乙方享有甲方提供的相应的劳动保护和劳动条件。

(二)乙方享有甲方执行的国家劳动标准提供的职业危害防护条件。

6.1 Party B is entitled to the corresponding labor protection and working condition by provided by Party A.6.2 Party A shall provide Party B with preventing conditions against occupational hazard in accordance with the State’s labor standard.第七条(劳动纪律和规章制度)Article 7 Labor Discipline and Regulations and Rules

(一)甲方应根据国家有关法律、法规,依法制定各项规章制度。

(二)乙方应诚实守信,自觉遵守国家的法律、法规和社会公德、职业道德,自觉维护甲方的声誉和利益,保守甲方秘密。

(三)甲方有权根据乙方的表现或行为,依据国家的法律、法规、行政规章和甲方的规章制度,给予乙方相应的奖励或处理。其中:

1、乙方如发生符合甲方《职工奖励办法》规定的积极行为的,甲方可以按照《职工奖励办法》给与乙方奖励;

2、乙方如发生违反甲方规章制度的消极行为的,甲方有权按《职工违规处理办法》给与处理。7.1 Party A shall formulate various regulations and rules in accordance with the State’s laws and regulations.7.2 Party B shall deport himself with sincerity and good faith, abide by the State’s laws and regulations and social ethics and professional ethics, maintain Party A’s reputation and interests initiatively and keep secret Party A’s confidential information.7.3 Party A may award or treat Party B as follows in the light of Party B’s performance and acts and in accordance with the State’s laws, regulations and administrative rules and Party A’s regulations and rules.1)If Party B has any positive actions deserving award as provided in Party A’s Rules of Awarding Employees, Party A may award Party B in accordance with the Rules of Awarding Employees.2)If Party B has committed any actions in breach of Party A’s regulations or rules, Party A may treat him or her in accordance with the Rules for Treatment of Employees in Breach of Regulations.第八条(教育与培训)Article 8 Education and Training

(一)甲方可以根据工作需要不定期地对乙方进行所必须的教育与培训。

(二)乙方应参加甲方的各项教育与培训安排。

(三)凡由甲方出资培训乙方,双方另行签订《培训/教育协议》,因乙方原因而提前解除劳动合同,乙方应赔偿甲方的培训等费用,具体赔偿标准执行《培训/教育协议》的约定。

8.1 Party A may educate or train Party B irregularly when necessary in the light of the working requirements.8.2 Party B shall participate in all the education and training courses arranged by Party A.8.3 Where Party A invests in training of Party B, the two parties shall conclude agreement for education/training separately;if this Employment Agreement is terminated earlier than originally stipulated for reasons attributable to Party B, Party B shall compensate Party A the training fee in accordance with the stipulations in such agreement for education/training.第九条(保密约定)Article 9 Confidentiality

(一)双方签订本合同后,乙方应遵守甲方《保密条例》,不得泄露甲方秘密,不得在合同期内再受聘其他任何单位从事与甲方相同或类似或有竞争冲突的业务。不得引诱甲方的其他在职职工离职。

9.1 Party B shall, after signing of this Agreement, observe Party A’s Confidentiality Rules, and may not disclose any of Party A’s confidential information;during the validity term hereof, Party B may not engage in any business similar with or in competition with Party A’s business for any other employer, and Party B may not induce other employees working for Party A to resign from Party A.(二)乙方在合同期内,属其岗位职务行为或主要利用甲方的物质技术条件所产生的所有专利、版权和其他知识产权归甲方所有,乙方无权进行商业性开发。

9.2 Any and all patents, copyrights and other intellectual property rights produced by Party B as his or her work duty or mainly by utilizing Party A’s material during the validity term of this Agreement shall be Party A’s property, and Party B is not entitled to any commercial rights pertaining thereto.(三)甲乙双方另订《保密协议》,具体确定双方的权利义务。乙方在本合同存续期间和终止解除后承担甲方《保密协议》中规定的保密义务。

9.3 Party A and Party B are to enter into Non-disclosure Agreement separately, so as to stipulate the obligations and rights of the two parties.During the validity term of this Agreement and after the termination hereof, the confidentiality obligation stipulated in the Confidentiality Agreement has binding force upon Party B.(四)乙方如在本合同存续期间,违反《保密协议》约定的,视作违纪行为,按《职工违规处理办法》有关规定处理。

9.4 If, during the validity term of this Agreement, Party B breaches the Confidentiality Agreement, Party B shall be deemed as having breached Party A’s disciplines and is to be treated in accordance with the Rules for Treatment of Employees in Breach of Regulations.(五)乙方因违约给甲方造成经济或名誉损失的,应承担侵权赔偿责任,甲方有权利向乙方追偿经济损失。

9.5 If Party B breaches this Agreement and thereby causes any economic loss or reputation loss, Party B shall bear the liability therefor and Party A may have the right of recourse against Party B for any economic loss.

根据《中华人民共和国劳动法》(以下简称《劳动法》)、《中华人民共和国劳动合同法》(以下简称《劳动合同法》)等有关法律法规的规定,甲乙双方遵循合法、公平、平等自愿、协商一致、诚实信用的原则,签订本合同,共同遵守本合同所列条款。

一、合同期限与试用期

(一)甲乙双方同意按以下第 种方式确定乙方的合同期限。

2、无固定期限:从201 年 月 日起。

(二)甲乙双方同意按以下第 方式确定乙方的试用期限。

三、工作时间和休息休假

1、标准工时制,即每日工作8小时,每周工作40小时,每周至少休息1日。公司出勤制度规定的上下班期间之休息时间不计入标准工时。

2、综合计算工时工作制,即经劳动保障行政部门审批,乙方所在岗位实行综合计算工时工作制。

(二)甲方由于生产经营需要延长工作时间的,按《劳动法》第四十一条执行。

(三)乙方依法享有法定节假日、年休假、婚假、产假、陪产假、丧假等有薪假期。

(四)乙方的休息休假安排依据国家法律法规及公司规章制度规定。

四、劳动报酬

(一)乙方正常工作时间的工资标准(计算加班工资基数),按下列第 种形式执行,并不低于当地最低工资标准。薪资结构若有变动,以甲方《薪資制度及发放管理办法》之最新规定为准。

1、直接人员I类:正常工作时间的工资为1808元/月。平日加班费15.58元/时,假日加班费20.78元/时,通过技能考核后享有技能津贴,绩效奖金0-50元/月,全勤奖0-30元/月,年资奖金0-50元/月,伙食补助11元/天(当天出勤需满4小时)。正常工作时间的工资调整根据市有关规定予以增加,技能津贴根据甲方技能考核制度评定,绩效工资依据甲方绩效考核制度评定。

2、直接人员Ⅱ类:正常工作时间的工资为1808元/月。平日加班费15.58元/时,假日加班费20.78元/时,技术津贴依职系职等确定,绩效工资依据甲方绩效考核制度评定,全勤奖0-30元/月,年资奖金0-50元/月,伙食补助11元/天(当天出勤需满4小时)。

3、间接人员:以201 年 月个人薪资签呈为准。个人薪资以通知单方式告知本人。其中,正常工作时间的工资为1808元/月,职务津贴依职系职等确定,绩效工资依据甲方绩效考核制度评定,全勤奖0-30元/月,年资奖金0-50元/月,伙食补助11元/天(当天出勤需满4小时)。

(二)甲方依法安排乙方加班的,按《劳动法》第四十四条的规定支付加班工资。

(三)工资通过银行转账方式,以法定货币支付,不以实物或其它有价证券等形式替代货币支付。

(四)甲方给乙方发放工资的时间为:每月7日。若在此日期前无法完成薪资核算,发放工资的时间可以延长至12日。若因生产经营困难,征得工会书面同意后,发放工资的时间最迟不超过每月22日。

五、社会保险和福利待遇

(一)甲乙双方按照国家和省、市有关规定,参加社会保险,缴纳社会保险费。BM2-021-002-RO修订日期:20140701

(二)乙方患病或非因工负伤,甲方按国家和省、市的有关规定给予乙方享受医疗期和医疗期待遇。

(三)乙方患职业病、因工负伤的,甲方按《职业病防治法》、《工伤保险条例》等有关法律法规的规定执行。

(四)甲方为乙方提供之其它福利待遇依公司规章制度。

六、劳动保护、劳动条件和职业危害防护

(一)甲方按国家和省、市有关劳动保护规定,提供符合国家安全卫生标准的劳动作业场所和必要的劳动防护用品,切实保护乙方在生产工作中的安全和健康。

(二)甲方按国家和省、市有关规定,做好女员工和未成年工的特殊劳动保护工作。

(三)若乙方从事之作业,可能产生职业危害,甲方采取配备防毒口罩、防护手套等各种防护措施,并每年组织乙方进行职业病体检。

(四)乙方有权拒绝甲方的违章指挥,强令冒险作业;对甲方危害生命安全和身体健康的行为,乙方有权要求改正或向有关部门举报。

七、规章制度

(一)甲方依法制定的规章制度,应当告知乙方。乙方认可并同意甲方之员工纪律、公司规范。《员工手册》作为本合同附件与劳动合同具有同等的法律效力。

(二)乙方应遵守国家和省、市有关法律法规和甲方依法制定的规章制度,按时完成工作任务,提高职业技能,遵守安全操作规程和职业道德。

(三)乙方自觉遵守国家和省、市计划生育的有关规定。

八、合同的变更、解除、终止

(一)符合《劳动合同法》规定的条件或者经甲、乙双方协商一致,可以变更劳动合同的相关内容或者解除固定期限合同、无固定期限合同和以完成一定工作为期限合同。

(二)劳动合同之变更,双方应当采用书面形式,签订劳动合同补充协议。变更后的合同文本双方各执一份。

(三)《劳动合同法》规定的终止条件出现,终止本劳动合同。

九、经济补偿金、医疗补助费的发放

解除或者终止本合同,经济补偿金、医疗补助费等发放按《劳动合同法》和国家、省、市有关规定执行。

十、合同解除和终止手续

甲乙双方解除和终止本合同的,乙方应按双方约定,办理工作交接等手续。甲方应依法向乙方出具书面证明,并在十五日内为乙方办理档案和社会保险关系转移手续。

十一、争议处理

甲乙双方发生劳动争议的,应先协商解决。协商不成的,可以向本公司工会寻求解决或向依法设立的劳动争议调解组织申请调解;也可以依法申请劳动争议仲裁、提起诉讼。

十二、补充约定事项

(一)乙方伙食费、住宿费、便利店消费金额等从工资扣除。伙食费、住宿费计算方式依甲方公司规定,便利店消费金额依乙方实际消费金额。

(二)乙方造假资料、隐瞒个人档案入职者,无论何时发现,一律开除处理。

(三)连续工作时间自乙方进入甲方工作之日(到职日)起算。乙方承诺当年年休假在壹年内视个人及公司状况自行安排休完。该壹年期限是从当到职日起至下到职日止。因乙方个人原因未在上述期限内休完,且未书面申请补休,视为自愿放弃未休年休假。

(四)乙方同意签订保密合同。保密合同作为本劳动合同的附件,具有同等法律效力。

十三、其它

(一)本合同未尽事宜或合同条款与现行法律法规规定有抵触的,按现行法律法规执行。

(二)本合同自甲乙双方签字盖章之日起生效,涂改或未经书面授权代签无效。

(三)本合同一式两份,甲乙双方各执一份。两份合同间甲方应加盖骑缝章。
